No bail for dad charged with DUI

A man on probation for driving under the influence with his son in the vehicle last year was arrested Thursday on another DUI charge while allegedly on his way to pick up his kids, prosecutors said.
Hans Schuldt, 27, made an initial appearance Friday before 9th Circuit Judge Timothy C. Day on a misdemeanor DUI charge.
Schuldt also is facing a petition to revoke his probation in a March 2009 DUI case, in which he was convicted of driving under the influence with his 6-year-old son in the car. Day said Schuldt told the court orally and in writing that he regretted his actions in the 2009 case and had seen the error of his ways after his son was placed in a foster home for a night.
Now Schuldt is accused of having a 0.17 blood-alcohol concentration while on his way to pick up his three kids from day care, Day said.
Day did not set bail on the petition to revoke probation on Schuldt’s 2009 DUI, which means Schuldt will remain in jail until at least his next hearing. Day set Schuldt’s bail at $5,000 cash in the new DUI case.
Schuldt, who did not enter a plea, said he is the primary caregiver for his children and asked the judge to set bail on the petition to revoke his probation so he might be released to care for them. He said he would submit to alcohol breath tests twice a day and would attend Alcoholics Anonymous classes daily.
Day said he couldn’t allow that.
“I’m not sure that’s adequate to fulfill the goals of protecting the community,” Day said.
According to court documents, police responded to a report about 5:30 p.m. Thursday of a gray Buick Rendezvous driving erratically down the pass and running other vehicles off the road.
Police made a traffic stop on Highway 22 and the driver, later identified as Schuldt, said he had a couple of beers at Grand Targhee Resort, records say.
Schuldt refused to take any field sobriety tests or get out of his car, so police physically removed him from the vehicle and placed him in handcuffs, records say. A portable breath test showed Schuldt’s blood-alcohol concentration was 0.17, records say.
In court, prosecutors said Schuldt was on his way to pick up his children at day care.
A Department of Family Services agent made arrangements for Schuldt’s three children to be picked up from day care and placed in a foster home, records state.
